TERMS AND CONDITIONS OF ONLINE BOOKING FOR ACCOMMODATION SERVICES Mont Blanc mountain refuges - normal route
The French Federation of Alpine and Mountain Clubs (FFCAM), a public utility association under a 1901 law, having its registered office at 24 avenue de Laumière 75019 PARIS, SIRET no. 775 671 316 00260, (Civil liability insurance, AXA policy no. 4706458904) operates an electronic system of remote selling (online sales) of accommodation services in refuges located along the Mont Blanc normal route.
Two online booking channels are available: one for “business” customers and one for “individual” customers.
Any reservation made through this system assumes full and unreserved consultation and acceptance of these terms and conditions.
The customer is required to agree to these general terms and conditions of sale at the time of booking before final confirmation of the reservation.
The customer has the option of saving and printing out these general terms and conditions using his browser or PC's standard features.
All the information relating to bookings accessible via the online booking system is presented in French, as well as in several other foreign languages. Only the French version is binding, automatic translations produced by Google do not render the FFCAM liable.
ARTICLE 1 : OBJECT
These terms and conditions of sale determine the obligations and rights of the parties relating to bookings made through this site in the refuges located along the normal access route up Mont Blanc.
The accommodation services are sold by FFCAM. They require the payment of a deposit online at the time of booking.
The “customer” refers to any person who purchases accommodation services in the refuge online, whether they be professionals or private individuals.
The customer declares they are legally entitled to enter into these terms and conditions.
ARTICLE 2 : TERMS AND CONDITIONS OF BOOKING OF ACCOMMODATION SERVICES FOR ALL CUSTOMERS
Online booking requests are made by submitting the shopping cart displayed after date(s) and services have been selected.
The basket refers to all the services that can be purchased in a single operation.
The stay means one or more consecutive nights in the same accommodation.
A stay cannot exceed 2 consecutive nights.
It is possible to book for up to 9 people per chosen date, guide(s) included.
The online booking procedure comprises the following steps:
• Login to the customer account: connection to an existing account or creation of a customer account (contact details of the customer and password to be entered).
• Step 1: Display of availability
• Step 2: choice of services
• Step 3: Information concerning the stay and compulsory filling in of the customer identification form. The customer certifies that the information provided is correct, especially as regards their surname, first name, date of birth, nationality and capacity (guide, trainee guide, including professional card number, private individuals).
This information is compulsory before the booking can be confirmed.
• Step 4: Summary and verification of the details of the order, the amount of the deposit, estimated total price, correction of any errors and viewing of the terms and conditions of sale.
By clicking on the “CONFIRM AND PROCEED TO CHECKOUT” button, the customer validates and confirms their order and the information provided, declares they have read and accepted the terms and conditions of sale, and is thereby irrevocably bound by them.
• Step 5: Online payment of the deposit in order to validate the booking – Article 6 -
• Step 6: Automatic sending of an email to the customer's mailbox with the booking voucher in the customer's name.
It is up to the customer to ensure successful completion of an order.The customer acknowledges that the data recorded on the site are proof of the transaction (date, services booked), and the data recorded by the payment system described below are proof of the financial transaction.
ARTICLE 3 :RESPONSIBILITY OF THE FFCAM WITH RESPECT TO THE ONLINE RESERVATION PROCEDURE
The booking system is designed to make it easier for customers and caretakers to make and manage accommodation bookings in mountain refuges.
It is specified that the refuge caretaker is bound to the FFCAM by a common interest mandate with regard to the provision of accommodation, and that he provides, for his sole profit, and at his own risk, an ancillary catering activity.
The box for booking catering services which appears at the end of the booking form is intended for the information of the refuge caretaker and is not binding on the FFCAM.
The accommodation and service is the sole responsibility of the caretaker of the refuge concerned.
The FFCAM shall in no way supersede the caretaker when it comes to the management and operation of the refuge. The Federation has no authority to intervene in any dispute between a customer and the refuge caretaker, nor can it be held responsible for the latter.
Any observations and complaints made by users must be made in accordance with Article 14 of these general terms and conditions.
ARTICLE 4 : PRICE
The prices indicated in the price schedule specific to each refuge are in euros, per person and are those in force at the time the order is placed.
The amount shown does not include current taxes applied in each building at the time of booking (tourist tax, heating tax, etc.).
Reduced rates are valid only on presentation at the refuge of the specific documents requested by the FFCAM.
ARTICLE 5 : PAYMENT OF THE DEPOSIT AT THE TIME OF BOOKING
In order to validate their booking, the customer makes an online payment to cover the deposit for their accommodation and the stay they have booked.
This amount is calculated automatically during the online booking procedure.
Payment is made by credit card, through secure internet pages. Bank card details are encrypted using SSL (Secured Sockets Layer).
Electronic cards or E-cards are not accepted by the system for technical reasons.
ARTICLE 6 :PAYMENT OF BALANCE DUE FOR THE STAY
The balance of services booked must be paid upon arrival at the refuge according to the arrangements in place at each location.
When booking, the customer's attention is drawn to the methods of payment accepted by the refuge. For instance, bank cards are generally not accepted in refuges: payment may be made by cheque, cash and chèque-vacances.
Reduced rates will be granted only upon presentation to the refuge caretaker of relevant valid supporting documents (FFCAM license, reciprocal association card, professional ID, etc.).
The customer must be in possession of the document in question.
Failing this, the customer will be charged the normal rate.
In case of non-payment by the customer upon arrival, the customer may be refused accommodation.
ARTICLE 7 : DEADLINE FOR BOOKINGS
Internet reservations are possible up to 11 days before the day of arrival, subject to availability.
Reservations can be made by telephone with the caretaker for stays taking place within the following 10 days.
ARTICLE 8 : PERIOD OF VALIDITY OF THE BOOKING
The customer's booking is guaranteed until the arrival deadline indicated on the booking form (maximum 5.00 p.m.) Beyond this deadline the customer's booking will be cancelled and the deposit will be kept by the FFCAM.
ARTICLE 9 : NO RIGHT OF WITHDRAWAL
Pursuant to the provisions of articles L221-2, 5° and L221-28, 12° of the French Consumer Code, reservations made on the FFCAM website do not benefit from the right of withdrawal provided for in articles L221-18 (et seq.) of the same Code concerning distance selling.
Consequently, reservations made on the site are governed exclusively by the conditions of cancellation and modification provided for in these General Terms and Conditions of Sale and the Customer may not avail themselves of the right of withdrawal.
ARTICLE 10 :MODIFICATION OR CANCELLATION OF A RESERVATION BY THE CUSTOMER
10-1 Modification of a reservation
A customer's reservation can only be modified in one respect: i.e. in terms of the name of the guide or trainee guide, which can be changed up to 48 hours before the stay.
The names of the other participants in the stay cannot be changed. In the event that a participant is no longer able to take part in the stay, the customer must cancel the reservation of the participant concerned (see article 11-2) and make a further additional reservation in their customer space online. If the stay is to take place less than 10 days after the date of modification, the cancellation must also be made online and the additional reservation must be made directly with the refuge's caretaker.
Any increase in the number of participants or in the length of a stay requires a further additional booking on line in the customer space on the FFCAM website.
10-2 Cancellation of a reservation.
The customer is free to cancel their reservation.
This cancellation can only be carried out online, by the customer logging in to their account.
The deposit paid by the customer is refundable under the following conditions:
- In the case of a cancellation more than 24 hours before the first day of the stay, beginning at 0:00 French time (GMT +2): the deposit is refunded minus a deduction of 2 euros per night/person modified or cancelled to cover administrative costs and bank charges.
- In case of cancellation less than 24 hours before the first day of the stay, beginning at 0:00 French time (GMT +2): the deposit will not be refunded and will be kept by the FFCAM.
For example, in the case of a booking for the night of 25 to 26 July (i.e. D-Day: July 25 beginning at 0:00), the customer may cancel at no charge (apart from administrative fees) up until 23 July (i.e. D-1) at 11.59 p.m.The FFCAM will reimburse the customer the balance of the deposit as soon as possible after cancellation.
ARTICLE 11 : INTERRUPTION OF STAY
The customer is free to interrupt their stay at any time.
In the event that the customer interrupts their stay, the deposit paid by the customer at the time of booking for the remaining accommodation/nights will not be refunded and will remain the property of the FFCAM.
ARTICLE 12 : CANCELLATION OF A BOOKING BY THE FFCAM
The FFCAM may cancel bookings at no cost prior to the start of the stay if it is prevented from providing the service due to exceptional and unavoidable circumstances, in particular due to snow and weather conditions or safety concerns.
The FFCAM will inform the customer of this cancellation as soon as possible before the beginning of the stay.The customer has the right to a full refund of the payments made but may not demand any additional compensation for any losses that may have been incurred.
ARTICLE 13 : ADMINISTRATIVE PROVISIONS SPECIFIC TO THE NORMAL ACCESS ROUTE TO MONT-BLANC (Nid d’Aigle, Tête Rousse et Goûter)
Customers are informed that, by a decision of the Prefecture of Haute-Savoie, all those purporting to climb the Mont Blanc must produce proof of a booking in a refuge, and that police checks may be carried out along the entire route.
As a result, bookings in one of the lodgings located on the normal route are subject to the customer providing the following information: name, first name, date of birth, nationality and capacity (guide, trainee guide, including professional card number, private individual).
Any stay or spot for which all the personal details relating to a participant have not been provided will result in the booking not being fulfilled.
A reservation voucher, with the customer's name, is generated at the end of the booking process. This voucher is sent by email to the customer. It is also present in the customer's account.
In cases where direct booking by telephone with the caretaker is possible, the customer will then be invited by email to fill in the identification form within a maximum of 48 hours and will receive their documents by email.
Customers are advised to print their booking confirmation email and the voucher which they may be asked to produce upon arrival at the refuge.The FFCAM cannot be held responsible for any errors regarding the identity or the capacity of customers, or for the lack of proof of booking in the event of checks.
ARTICLE 14 : CLAIMS
Claims must be made by the customer by registered letter with proof of receipt or by email within 30 days of the end of the stay:
- To the refuge caretaker
- To the FFCAM 74 departmental committee at the following email address:email@example.com
ARTICLE 15 : DISPUTES
This contract is subject to French law and its execution shall be subject to the jurisdiction of the French courts..
ARTICLE 16 : RESPECT FOR PRIVACY
Creation of a customer account on the online booking site requires the customer to communicate a certain amount of personal data. These data, which are necessary for processing of the order and management of reservations, are secure, kept confidential and, without consent, will not be used for any commercial use by third parties other than the refuge caretaker.
Pursuant to the provisions of the French Data Processing law of 6/01/1978, customers are informed that the information provided through forms on the site is necessary for processing of their reservation and is intended for FFCAM or its partners for management purposes.
In particular, it will be communicated to the caretaker of the refuge in which the reservation is made.
The FFCAM declares it has completed the required formalities with the CNIL (CNIL declaration No. 142 4403 dated 15/04/2010).
If the customer declares that they wish to receive offers from the FFCAM, its affiliated clubs or their partners by ticking the boxes provided for this purpose, the FFCAM may use the personal data provided, either directly or through its contractual partners, for the purpose of information regarding the activities of the federation and clubs, or their partners.
Customers have the right to access and rectify data concerning them by applying to the FFCAM, Data Protection Officer, 24 avenue de Laumière, 75019 Paris.This right may be exercised by email to the following address: firstname.lastname@example.org.
